The License.
The Dock'Em™ OpenDoc compliant VIEWER ("Dock'Em") is produced by MetaMind Software, Inc. ("MetaMind") and is a proprietary product of, and is owned by MetaMind. By using this software, you indicate your acceptance of the terms of this agreement.
Dock'Em™ consists of an OpenDoc compliant "Editor" (the "software"). MetaMind grants you a personal, non-transferable, non-exclusive license to use the software. You may not disassemble, decompile, reverse engineer, modify, alter or adapt the software. You are not licensed to, and you may not, rent, lease, transfer, sell, sub-license, assign or transfer the license of, or make any unauthorized use of the software.
You may distribute this VIEWER version to anyone who has the need of viewing documents created with Dock'Em™. Please distribute the entire folder in which you find the Viewer.
Disclaimer.
MetaMind disclaims all warranties with regard to the software, including the implied warranties of merchantability and fitness for a particular purpose. You expressly acknowledge and agree that use of the Software and Materials is at your sole risk. The Software and Materials are provide "AS IS" and without warranty of any kind.
In no event, including negligence, will MetaMind be liable to you for damages, including lost profits, lost savings or other incidental, special, or consequential damages of any kind arising out of the use or inability to use the software even if MetaMind or any of its resellers or agents have been advised of the possibility of such damages, or for any claim by any other party.
Complete Agreement.
If you access the software, you acknowledge that you have read this agreement, understand it, and agree to be bound by its terms and conditions and agree that it is the complete and exclusive statement of the agreement between you and MetaMind, which supersedes any prior agreement, oral or written, and any other communications relating to the subject matter of this agreement.
Controlling Law.
This agreement will be governed and construed by the laws of the State of California. If for any reason a court of competent jurisdiction finds any provision of this license, or portion thereof, to be unenforceable, that provision of the license shall be enforced to the maximum extent permissable so as to effect the interest of the parties, and the remainder of the license shall continue in full force and effect.
